CITY OF NAGA, Bicol Region – Filipino nationalists and the militant sector are infuriated over the cowardly posture of authorities in demanding to take in custody US Marine suspect Joseph Scott Pemberton for the killing of Filipina transgender Jennifer Laude.

Philippine judiciary inferiority to American legal tactics in protecting its own kind arising from the killing of Filipina transgender by a US Marine serviceman will soon be put into acid test as anti-US protesters drumbeat their disgust over the Aquino government’s weakling posture of demanding to take in custody the murder suspect.

Rights groups and some nationalist lawmakers are raising hell over the week to get in Philippine custody the “fucking ass-hole” Marine soldier Joseph Scott Pemberton, the suspect who murdered late Saturday night Filipina transgender Jennifer Laude inside an Olongapo motel room.

US servicemen, on rest and recreation after war exercises, are known to loiter Olongapo streets to get a “good fuck of Filipinas”.

The Olongapo police had already wrapped its investigation, and top US military officials had acknowledged that a US marine was involved in the killing, who is now under US military custody inside US warship USS Peleliu docked off Subic Bay.

But, holding “by the balls” murder suspect Pemberton and dragged him before teethless Philippine court for prosecution seems to be nightmarish experience as US servicemen here are protected from local prosecution owing to lop-sided agreement provisions crafted by the US and Philippine governments in allowing US troops to use Philippine territories in war exercises and port-use facilities.

Kabataang Partylist Representative Terry Ridon has aired his fear of Washington’s posture in protecting the Marine suspect and shielding him from Philippine custody.

“The delay in the filing of charges against Pemberton due to custody issues should be reason enough for Washington to waive custody and for the Philippine government to insist custody of Pemberton,” Ridon stressed, explaining that at this point, Pemberton’s custody is solely based on the mere voluntary cooperation of the US military.

“This custody issue is a clear proof that the Visiting Forces Agreement (VFA) is truly an unequal treaty. Instead of protecting Filipinos, the provisions of the VFA on custody of criminally-liable military servicemen are actually barring us from exacting justice,” Ridon said

Human rights advocacy groups and the League of Filipino Students also condemned the murder.

“The killing of transgender woman Jennifer Laude by a US serviceman is the most recent vivid violation of people’s rights, a consequence of lopsided military agreements between the US and the Philippine governments. The US-RP Military Bases Agreement to the VFA and the US-GPH Enhanced Defense Cooperation Agreement have become licenses for numerous gross transgressions, especially on the rights of Filipino women and children,” said Cristina Palabay, Karapatan secretary general.

“It’s a shame that the government can’t even protect our people from being raped and wantonly killed by American forces. This embarrassment alone should be more than enough reason to stop these so-called visitors from playing havoc in the country and junk VFA, EDCA and other exploitative agreement,” Charlotte Velasco, spokesperson of League of Filipino Students said.

Pemberton on Saturday night met Laude inside a bar and agreed to make the night at a motel. Speculated reports said Laude might have been killed after the Marine discovered she “was not a real she.”

The US-RP Balikatan War Exercises has angered militant sectors on the rise of prostitution, aside from downgrading Philippine sovereignty.

“This is the second time that a US serviceman committed a criminal offense in the country. Nine years ago, Lance Corporal Daniel Smith was charged and convicted for the rape of a Filipino woman. His custody remained with the United States of America during his trial, which exposed the lopsided nature of VFA,” Ridon said. [BicolToday.com]
