Investigation on 50 Muhlach supporters to proceed, regional prosecutor assigns new fiscal

CITY OF NAGA, Bicol Region, 03Oct2013 ( – The preliminary investigation of 50 Muhlach supporters named in the complaint for alleged serious illegal detention filed by the Mayor of Tigaon and 15 others will proceed, as the Regional Prosecution Office in Legaspi City assigned another prosecutor to replace the Camarines Sur Provincial Prosecutor who inhibited himself

Regional Prosecutor Mary May B. De Leoz on Friday, September 20, designated Deputy Regional Prosecutor Jose Demosthenes M. Salgado as acting provincial prosecutor of Camarines Sur on case “to conduct the preliminary investigation in NPS No. V-10-INV-131-01047, entitled Arnulf Bryan B. Fuentebella, et al, versus Rogelio Pervera, Jr. et al, for serious illegal detention and violation of Article 267 of the Revised Penal Code, and if warranted by the evidence, to file the corresponding information in court.”

Salgado’s designation was in response to Richard T. Cu, Camarines Sur provincial prosecutor, motion to inhibit himself from taking over the preliminary investigation of the complaint for reasons cited in his letter to the Regional Prosecutor Office on September 10. (See related article)

Salgado is the officer-in-charge of the City Prosecution Office of Naga City.

Cu inhibited himself from conducting preliminary investigation on the 50 Muhlach supporters named as respondents on the reason that two of the respondents, Goa Mayor Antero Lim and Vice Mayor Alfredo Gonzaga, are represented by his office in another case.

His reasons to inhibit are anchored on delicadeza and to preserve impartiality in the course of justice. []
