CITY OF NAGA, Bicol Region, 02Oct2013 (BicolToday.com) – The provincial prosecutor, tasked to conduct preliminary investigation of 50 supporters of Aga Muhlach named as respondents in a criminal complaint, has inhibited himself as to observe impartiality, and asked the Regional Prosecutor in Lagazpi City to appoint a substitute.
Richard T. Cu, provincial prosecutor of Camarines Sur, on Tuesday (September 10) inhibited himself from conducting preliminary investigation on the complaint filed by Tigaon Mayor Arnie Fuentebella against 50 Muhlach supporters for alleged serious illegal detention and violation of Article 267 of the revised penal code. The complaint was docketed as NPS NO. V-10-INV-131-01047. (See related article)
Cu, in his decision to inhibit, said his office is representing Goa Mayor Antero Lim and Vice Mayor Alfredo Gonzaga, among other officials of the Local Government Unit of Goa, Camarines Sur, in another case in Special Civil Action entitled “Enrico Enciso vs. Mayor Antero Lim, et al docketed as “T-1212, for Mandamus and Prohibition, with Application for Preliminary Mandatory Injunction” pending before the Regional Trial Court, Branch 30, at San Jose, this province.
Cu said in Fuentebella’s complaint, Mayor Lim and Vice Mayor Gonzaga are included as respondents, the same persons his office is representing in the Special Civil Action.
He said his motion to inhibit is “to avoid the impression that his actions are motivated by a consideration beyond the merits of the case and interest of justice.” And, to avoid “being a probable source of conflict of interest, the public scrutiny over this matter are going to be restless.”
He forwarded the entire records of the complaint to Mary May De Leoz, Regional Prosecutor, Legaspi City for the Regional Prosecution Office to decide on his replacement to handle the preliminary investigation of the complaint filed by the Tigaon Mayor.
