CITY OF NAGA, Bicol Region, 30Sept2013 (BicolToday.com) – Fifty (50) followers of defeated Congressional candidate Aga Muhlach are slapped by a criminal complaint on alleged serious illegal detention and violation of Article 267 of the revised penal code when their vigil and rally for the actor during the Comelec canvassing of votes in Tigaon, Camarines Sur, had turned into a violent riot that was marred by rock-throwing incidents.
Included in the complaint are Goa Mayor Antero Lim, Goa Vice- Mayor Alfredo Gonzaga, San Jose councilor Virgilio Panuelos, defeated Tigaon Mayor bet Elmo Bombase, Tigaon ex-Vice Mayor Redito Clarino, Lagonoy ex-Vice Mayor Ferdinand “Mamo” Melgarejo, defeated Sangay Mayor bet Francisco “Eco” Tria, DWKN radio commentator Francis “Frank” Sotero, and several village chiefs. The rest are political ward leaders
The complainants are Tigaon Mayor Arnulf Bryan B. Fuentebella and 15 others who allegedly claimed they were trapped inside the municipal building during the Comelec canvassing of election results on May 14 when hundreds of supporters of Muhlach started converging en masse for a vigil inside the municipal compound that finally turned into a violent riot 3 days later.
Muhlach was a candidate for Congress who lost to Congressman Wimpy Fuentebella, the mayor’s younger brother, in a hotly contested race when the two, at some time, had a margin of few hundred votes over the other.
Three days later, May 16, the crowd belonging to Muhlach’s camp had begun to swell by new arrivals aboard trucks and vehicles from the neighboring towns of Goa, San Jose, Lagonoy, Sangay, and Presentacion.
That night, tension had built-up after the crowd learned that Wimpy Fuentebella was proclaimed winner. Several persons, among the crowd, started throwing rocks at the municipal building, breaking up window glass panes, and causing property damages, while policemen and Army soldiers who had cordoned the area watched helplessly. According to reports, Mayor Fuentebella and his group were inside the building.
Named respondents in the complaint docketed as NPS NO. V-10-INV-131-01047 for preliminary investigation at the provincial prosecutor’s office in this city are: Rogelio Pervera, Jr., Ferdinand “Mamo” Melgarejo, Jacinto Burce, Jr., Antonio Senar, Elorde Espinosa, Siegfredo “Bong” Tolentino, Herman Quingquing, Julio Bombase, Arnulfo Clapis, Elmo Bombase, Virgilio “Beyong” Panuelos, Efren Rivero, Antero Lim, Busto Brutas, Emily Vargas, Amy de Vera, Tomas T. Rances, Leo Cea, Edmund Clapis,Sabas Palmaria, Gaspar Saonoy, Mario Collat, Felix Azor, Alfredo “Pidong” Gonzaga, Redito Clarino, Ronnie Callo, Noel Cominguez, Arnelo Enterino, Noel “Dwendino” del Rosario, Achilles Royol, Exekiel Sellan, Rodel Peloneo, Alfredo Partiarca, Aguinaldo Punto, Rico Seguenza, Manuel Estrella, Pilar Vegas, Venus Durante, Francis “Frank” Sotero, Fernan Coltivo, Francisco “Eco” Tria, Allan Formalejo, Danny Pontejos, Giselda Regaspi, Malvin D. Calvo, Joel T. Baturiano, Oscar D. Cielo, Semion E. Buenaagua, Alex Camacho, and Victor Sumagpang.
