Sorsogon teachers coop directors file for judicial consideration

SORSOGON CITY, 3July2013 (BicolToday.com) – The board of directors of  Sorsogon Public School Teachers and Employees Cooperative, Inc. opted for judicial consideration when their counsel filed the manifestation at RTC Branch 53 which assumed the jurisdiction over the case after it was raffled.

Except for Francia Biolena, the coop treasurer, the other defendants are connected with DepEd as elementary and secondary school principals and district supervisor.

This came about after the issuance of resolution by State Prosecutor Maria Carlota Deniega recommending for the filing of syndicated estafa against Nydia Bercasio, now deceased, Alex Rodriguez, Segundino Guab, Jorge Fuentes, Alfredo Camacho and Francia Biolena. The case against Dennis De Guzman was dismissed.

The information of the case does not require the respondent to post bail. The former general manager Mauricio Gabani will be a subject for preliminary investigation.

His participation in the syndicated scheme was noted.

Executive Judge Rofebar Gerona of RTC Branch 53 issued an order to Prosecutor Deniega to reply within five (5) days upon receipt, the judicial consideration sought by respondents education employees. Deniega will comply with the judge order when asked to comment on it.

The Clerk of Court of RTC Branch 53, Attorney Louella Jintalan explained that the Rules of Court mandate the judge to review the evidences, and shall rule on the issue after it received the reply from the prosecutor. The issue either, to grant, or not to grant bail to the defendant on the evidences on hand.

When asked if the counsel of the respondent filed a motion for review with the Department of Justice, she said that the court has not received any information regarding this, but since they have already acquired jurisdiction over the case, the court shall continue to peruse the documents on hand, to decide the pending legal remedies sought by the respondents.

The case against the coop officials were filed by eight investors, all of Gubat town who alleged that they were duped by the coop officers who allegedly invited them to invest without the security for their investments, that the board of the coop acted collectively having deprived them of their rightful dues and has violated RA 9520.
